| Tier 2 Skilled Workers : Tier 2 General Visa for the UK |
|
Tier 2 Skilled Workers category of Points Bases Immigration System of the UK replaced Work Permits scheme of the UK. Under Tier 2 you cannot apply for Entry Clearance unless you have the Sponsorship Certificate from the UK employer.
Under Tier 2, the UK Employers can sponsor the skilled workers from outside the EU or EEA area if they are not able to locate suitable skilled workers from within the EU or EEA area.
UK Employers need to first obtain a license from the Home Office for Tier 2 General or Tier 2 Intra Company Transfers.
UK Employers are also expected to undertake local recruitment exercise to demonstrate that there are no suitable skilled workers available within the EEA countries. UK Employers have to advertise the position for at least 4 weeks before the offer can be made to an individual from non-EEA country.
Once the UK employer completes the recruitment exercise or resident labour market test, they can issue a Sponsorship Certificate to the prospective employee.
If you have received a Sponsorship Certificate from a UK employer, you can then apply for Entry Clearance under Tier 2. If you are transferred from the UK employer’s group company in India, you will be considered under Tier 2 Intra Company Transfer (ICT). You will also need to demonstrate that you have appropriate amount of maintenance fund in your account.
